These Terms apply to all contracts between EB Sport & Technik GmbH, Holzgerlinger Str. 16, 71101 Schönaich ("BrandauBikes") and its customers for the purchase of bikes, parts and accessories – including in the online shop –, for workshop and repair orders, and for participation in courses, bike-fitting appointments and events.
Deviating terms proposed by the customer do not become part of the contract unless BrandauBikes expressly agrees to them in writing.
The display of goods in the online shop does not constitute a binding offer, but a non-binding invitation for the customer to order from BrandauBikes.
By clicking the order button, the customer submits a binding offer to purchase (§ 145 BGB). The online shop is aimed exclusively at buyers who have reached the age of 18.
After the order is received, the customer receives an automatic confirmation of receipt by email; this does not yet constitute acceptance of the purchase offer. A purchase contract is only formed once BrandauBikes expressly declares acceptance, or dispatches or hands over the goods.
The order is formed when the customer accepts a cost estimate – including via a digital approval link – or by handing over the bike with an express or implied instruction to proceed.
Cost estimates are non-binding unless a fixed price has been expressly agreed. If additional work not included in the cost estimate becomes apparent during the repair, BrandauBikes will consult the customer before carrying it out; without approval, such additional work will not be performed.
The contract is formed by booking (online, by phone or in person) and confirmation by BrandauBikes.
All prices include statutory VAT. For goods orders, shipping costs shown during checkout apply in addition.
Payment is made using the payment methods offered during the order or booking process. Workshop invoices are due upon collection or completion of the service, unless otherwise agreed.
In the event of late payment, statutory default interest applies.
Delivery is made to the address provided by the customer, or by collection in store.
Goods and installed parts remain the property of BrandauBikes until paid in full.
For the purchase of bikes, parts and accessories, the statutory warranty under §§ 434 et seq. BGB applies.
For workshop and repair services, the law governing contracts for work (§§ 633 et seq. BGB) applies.
Excluded from warranty are damages resulting from normal wear and tear, improper use, falls or accidents, or subsequent intervention by third parties.
Consumers (§ 13 BGB) have the right to withdraw from a purchase contract for goods ordered in the online shop within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which the customer, or a third party named by the customer other than the carrier, took possession of the goods.
To exercise the right of withdrawal, the customer must inform BrandauBikes (EB Sport & Technik GmbH, Holzgerlinger Str. 16, 71101 Schönaich, email: kontakt@brandaubikes.de) of the decision to withdraw by means of a clear statement (e.g. letter, fax or email). The model withdrawal form below may be used, though this is not mandatory. To meet the withdrawal deadline, it is sufficient to send the notice of withdrawal before the withdrawal period expires.
Effects of withdrawal: If the customer withdraws from this contract, BrandauBikes will refund all payments received, excluding delivery costs, without undue delay and no later than fourteen days from the day on which notice of withdrawal is received. The same means of payment used for the original transaction will be used for the refund, unless expressly agreed otherwise; no fees will be charged for this refund. BrandauBikes may withhold the refund until the goods have been received back, or until the customer has provided proof of having returned the goods, whichever is earlier.
The goods must be returned to BrandauBikes without undue delay and in any event no later than fourteen days from the day on which the customer notifies BrandauBikes of the withdrawal. The deadline is met if the goods are dispatched before the fourteen-day period expires. The customer bears the direct cost of returning the goods. The customer is only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to goods made to the customer's specifications or clearly personalised, nor to sealed goods not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery. It also does not apply to workshop/repair services fully performed at the customer's express request before the withdrawal period has expired.

Workshop and service appointments may be cancelled or rescheduled free of charge up to 24 hours in advance. In the event of a later cancellation or a missed appointment without cancellation, the reserved time may be invoiced in part or in full.
For courses, bike-fitting appointments and events, no refund is available upon cancellation. Instead, the customer may nominate a substitute to take the booked place, or will receive a credit voucher toward participation in one of the next sessions or group courses.
Cycling, even when practised properly, involves inherent risks. Customers take part in riding-technique courses, bike fitting and events at their own risk, and are themselves responsible for their riding, for choosing a group appropriate to their ability, and for their physical fitness.
Customers with pre-existing conditions, health limitations, or a need for regular or emergency medication must inform BrandauBikes or the course instructor in advance; where in doubt, a medical check of fitness is recommended.
Customers must follow the published rules of conduct and the instructions of the course leader.
BrandauBikes is liable without limitation for intent and gross negligence, and for injury to life, body or health.
In cases of simple negligence, BrandauBikes is liable only for breach of material contractual obligations, and limited to the foreseeable damage typical for this type of contract.
For bikes handed over for repair and equipment brought by customers, BrandauBikes is liable within the scope of the standard duty of care of a workshop business; no liability is assumed for damage caused by third parties or force majeure.
The law of the Federal Republic of Germany applies.
Should individual provisions be invalid, the validity of the remaining provisions is unaffected.
The place of performance and, to the extent legally permissible, the place of jurisdiction is the registered seat of BrandauBikes.
